Joshua Arap Sang's defense against ICC began yesterday, where he said that the ICC should not criminalize the Kalenjin culture. Circumcision, marriage and initiation were part of the community's culture for generations, and shouldn't be criminalized.
-He also argued that:
- He is a christian who believes in peace.
-His cousin and nieces have married kikuyus , and he wouldn't have incited his community against the kikuyus since they were part of his extended family.
-He transmitted messages of peace immediately after the Kiambaa church burning. He used most of the time
on his programs to broadcast educative programs. He further alleged that the cases had caused him to lose his job at Kass FM.
-William Ruto and Uhuru Kenyatta conceded defeat in 2002 when they were defeated by Kibaki. There was no violence, and iCC was not there then.
- The 2007/08 violence was spontaneous and was caused by the inefficiency of the electoral commission then under Samuel Kivuitu.
- In his final submissions, Sang said that he was 'collateral damage', and the prosecution needed to balance the accused in both the PNU and ODM side.
